These TOS are a binding contract between all users of BrainFox's platform, services and applications (together “Sharply Services”) owned by Sharply Labs Ltd.
By creating an account or accessing BrainFox in another way, you express your agreement to be bound by them.

The TOS incorporate the provisions of the Privacy Policy and Payment Policy, please review them.

In addition, by using Sharply Services you confirm that you have read and understood these TOS and agree to abide by them.

You confirm that you are at least 18 years old or have the permission of your parent or legal guardian (the one who takes responsibility for your compliance for these TOS).

In case you do not agree to abide by these TOS, you may not use any of Sharply Services.

Sharply Labs may update these TOS from time to time.

Important: You have the right to withdraw from any transaction with Sharply without any charge, before using the Sharply Services. However, once you begin downloading the application or using Sharply Services in any form, you will lose the right to cancel the transaction.

Services

BrainFox is an application that consists of several games and tools, which designed to help you to improve and measure your cognitive performance in particular games and categories. BrainFox's applications available on iOS and Android devices, also on Facebook.com website.

Description of Service and Pricing

By agreeing to the TOP and the Privacy Policy conditions, you have the permission to download the application or sign up to the Facebook application and get a free of charge version of Sharply services. In order to get full access to all games and features that included in Sharply Services, you must pay for the premium version (“Pro”) of BrainFox.

The pricing can be changed at our discretion. Please review the Payment Policy.

After downloading or installing the application on Facebook platform you must register to create an account.

Keeping confidentiality of your password in your account is under your own responsibility.

In addition to all possible activities that may occur under your account or password.

Each account cannot be transferable and must be used by its creator only.

Sharing your account with any third party is unauthorized and violates this TOS.

You agree to provide true and up to date information during the registration process.

Privacy

By using Sharply Services you agree to the terms mentioned in our Privacy Policy.

Restrictions and Termination

You confirm that:

You will use Sharply Services in a proper and lawful manner and do not violate any kind of law.

You will not infringe the rights of any third party.

You will not attempt to access, damage, hack or distribute the data of other users, third parties or Sharply Labs.

You will not reproduce, duplicate, copy, sell, resell any of Sharply Services.

You agree that Sharply Labs will not be liable to you or to any 3rd party for any kind of modification or discontinuance of Sharply services.

Violating these terms will lead to the termination of your account and access to Sharply Services, without any warning and payment refund. In addition, termination may occur even in case of suspicions for possible violations.
